Earlier today we reported that a German court had ruled in Apple’s favor regarding the Samsung Galaxy Tab 10.1 and a preliminary injunction was granted halting all sales and marketing for the device across the European Union. This is a huge blow to Samsung especially because it was selling so well in Europe over the past few weeks breaking all other tablet sales records — iPad 2 aside.

After reaching out to Samsung regarding this entire situation our sister site SlashGear finally received an official response from Samsung that should shed some light for all of you readers — and it doesn’t look like things went down very smooth over in Germany.

Samsung is disappointed with the court’s decision and we intend to act immediately to defend our intellectual property rights through the ongoing legal proceedings in Germany and will continue to actively defend these rights throughout the world.

The request for injunction was filed with no notice to Samsung, and the order was issued without any hearing or presentation of evidence from Samsung.

We will take all necessary measures to ensure Samsung’s innovative mobile communications devices are available to customers in Europe and around the world.

This decision by the court in Germany in no way influences other legal proceedings filed with the courts in Europe and elsewhere.”

According to this official statement not only did Samsung have no idea this was being filed and never received any sort of notice, nor did they get a chance to plead their side of the case either — sounds pretty outrageous to me. This is the first official word we have received regarding this mess and from the looks of things Samsung is not going down without a fight.

Sadly just like we said in the article this morning an appeal could take upwards of 4 weeks to get started so sales could be coming to a very quick halt if something isn’t done soon. Samsung plans to make their product readily available for everyone worldwide, and Europe so we should be hearing more very very soon. What do you guys think, is this Apple playing hard? They (Apple) are definitely playing hardball here.  The tablets aren’t identical, though they have similar width, black bezels.  That’s about it.  I’m not sure it resembles the iPad enough to constitute infringement.  The tabs have different backs, button layouts, aspect ratios, screens and operating systems.  It’d be hard to confuse the two when using either.

  4. All these lawsuits from Apple just brands Apple more and more as the bratty kid who just whines to the adults when the other kids (Google, HP/Palm, Microsoft) have more interesting toys.

  5. to me this shows how apple is not confident they can keep any kind of marketshare, unless they lockin their customers and swindle to make it so the playingfield is never even, hence remove links to stores outside of itunes, and this crap today. its time consumers should wake up and realize apple isnt making all their money because the are giving great deals to their customers, its because they are suckering them into an ecosystem they control and have removed all competition from.

    • Exactly!  That’s why Amazon and others are finding their own solution. Why give Apple 30 percent of every sale from your store just because you have an icon on someones tablet? Their  greed is going to be their demise.
       That is why we need competition. Go Sammy, Amazon, Google! They are already feeling the heat.

  6. I’m really not surprise. Samsung products do really mimic Apple. Touchwiz does look like iOS. The only thing Samsung can’t mimic is Apple’s build quality. Whats with all the plastic? Samsung should take a page from HTC. Create a more original Android overlay and improve on the build quality. 

    • This has nothing to do with touchwiz. The touchwiz for tablets is all about widgets and multitasking simultaneous apps. The ipad has neither of those capabilities. Apple is just getting started and has made it clear that they want to attack all other tablets as if they created the tablet computer and hold the copyright on it.

      And in typical Apple fashion, they are performing their corporate litigation muscle flex, to stifle and delay competing products because their next iPhone won’t seem so impressive by the time it gets announced in the Fall. The only real losers here, are the consumers …    Technology gets stifled, products get delayed, costs go up, choices narrow …

  7. Well… after all these stupid lawsuits from apple, I’m done with them. They are not getting one penny more from me. Mind you, I don’t have an iPhone or iPad because I don’t care for them. Long ago I realized what nerdshowandtell below said. They want to lock you in their system and be the only content provider. That’s the reason for iTunes, etc. It is not that I dislike all their products, I have a MacBook Pro, a MacBook for my wife, and iPad for my daughter and a couple of iPods but never been a fanboy. I use what works for me and I refuse to be locked into any system against my will. All my phones are Android and my tablet is an Asus Eee Pad.

  8. Apple is just using lawsuits and legal battles to stifle the progress of its competitors since it is unable to release the iPhone 5 by WWDC and its market share has taken an impact as a result. Pathetic! 

  9. I bet Samsung can’t countersue for loss of revenue after they winn in a couple of months. Pathetic. Besides, the galaxy tab is a widescreen, not the old, outdated letterbox. Try watching netflix on an iPad. you lose most of your screen when it tries to mimic widescreen. What the hell is the point?

  10. This is outrageous! This is just another evidence of some totalirism dangerous idea of Apple! If they had spent half of the money in R&D department, instead of law corridors, they could come with new ideas and innovations. Not just crappy iShit devices!!!!!

      And hence, they would be able to actually compete with the Galaxy Tab with better products, for the actual benefit of the costumers. But instead, it chooses to hamper and delay R&D advances in technology for everybody.

    Steve Jobs is a scared little man who has always been afraid to fight for real. It’s like watching a boxing fight where one contestant brags on and on about his strength and skill dissing out the other; until the fights begins when he screams like a little girl to the ref about the his rival’s short’s colors being wrong, his shoelace being untied, the gong wasn’t hit correctly, the girl is ugly, etc… everything he can do to avoid actual fighting.

    Stevie brags on and on about the greatness of Apple’s products, but when the big guys come to the fight he runs under his mommy’s skirt to protect him like a little girl.

    If Apple’s products are truly so great, then why be so scared? Fight the market and costumer battle, let the costumers decide which product is better.

  12. i wouldn’t be surprised one bit if the scenario went just as samsung has said, how could ONE SINGLE JUDGE make a ruling that would decide the fate of a whole countries ability to buy a product that they can want more than apple’s ipad or iphone? this is ridiculous & its more of a dictatorship act than anything else. this is not about samsung looking like ipad’s, it’s about apple not wanting you looking at porn, it’s about apple not wanting you using flash on there devices you pay hundred’s to own. it’s about apple stealing idea’s from cydia & claiming they been working on the said app for year’s, it’s about apple wanting to control with an iron fist & telling you what to like & what to buy, to pay $15 for there ipad magazine than getting a real paper magazine or better yet get it free on the internet *hence the reason they dont want flash on there device’s* first it’s apple saying we dont want this device being sold in this country then it’ll be we dont want *roku* being sold because it has the “look & feel” of our device & u.i.! apple is getting too much granted in there favor & we all know that this type of power doesn’t come CHEAP! it cost’s alot of $MONEY$ & bribery, i dont give a crap if you believe me or not. but if you dont then you’r not in reality my friend & reality if real fudged up! so unless you want to let companies tell countries & what they could & cant do or buy & soon even produce, seriously you better act now.
