Some good news in the direction of Samsung–it’s pay-out to Apple for copying has been overturned. We’re not saying Samsung really did copy the iPhone design but that’s the reason why the South Korean tech giant needs to pay the Cupertino company $400 million in damages. The decision is overturned in the United States and the Supreme Court is in the process of reassessing the case. Samsung filed a counter complaint earlier this year and said there’s be a miscalculation in the damages, no thanks to the arguments given by Apple.
The Federal Circuit is once again looking into the lawsuit and is expected to make a ruling on the $400 million figure and say if it’s the correct amount. Samsung is arguing that those patents only covered one part of the phone so the amount shouldn’t be that high. Of course, the court said phones are sold as one whole device and not as parts so full prices and revenues must be considered.
We’ll wait for the new decision to be handed down in the coming weeks. For now, we can say Samsung isn’t in a good place. The amount may be small for both Samsung and Apple but we all know this isn’t just about money. Apple just wants the world to know that Samsung is a copycat. We’re not saying it is one but this Apple-Samsung battle has been going on for years. We don’t think there will be an end to it soon. We’re just hoping Samsung will rise from the Note 7 failure and do better next year.
