Because they tell you before you get the services what the limitations are. You are allowed an unlimited amount of data, as the name states.
I don't like the limit, but I understand it and appreciate that they are letting me know in advance. It's not a definite, they're just letting you know before you get the phone and 2 year contract, and flip out when they enact those rules 6 months into your contract.
It sucks but it's not a surprise. How would you feel if you desperately needed directions to the hospital or something, and every 3G user was sucking up bandwidth tethering and using bittorrent :P Highly unlikely, but it's just to assure that everyone will get decent service, and I'm sure the limit will go up once 3G is fully in place.
