Why would you have to pay the upgrade fee to TMobile if you didn't get your phone through them?
The activation fee is simple to get around -- refuse to pay it. This usually works when you're at the end of your contract and going for a renewal, preferably towards the end of the month. Inform the sales rep that if you have to pay the activation fee you might as well go with "that iPhone thingy from AT&T", or come up with some drama about how you're a long-time TMobile customer and shouldn't have to pay stupid fees, etc etc. They'll either waive the activation fee or offer free accessories in an attempt to get the sale.
