Remember that $1-billion judgement Samsung was ordered to pay Apple? Well Samsung is not ready to give up yet, and they have convinced the judge who oversaw the case to look into the claims that jury foreman Vel Hogan concealed information during the screening process to pick the jury for the case. Judge Lucy Koh will “consider the questions” and look at how much information Apple attorneys had on Hogan. She has set a hearing for December 6 to look into the issue.



Samsung is clearly working every angle it can to get that massive judgement against it thrown out. Who wouldn’t? $1-billion is a whole lot of money. Samsung has been claiming that it did not receive a fair trial because Hogan did not disclose that he had been sued by his former employer, Seagate.

Samsung believes that because Seagate and Samsung have a “substantial strategic relationship” the suit should have been reported. The suit also led to Hogan declaring bankruptcy, a fact Samsung felt could sway his fair decision-making.

Cnet reports that its legal experts claim that is extremely hard to get a decision overturned for alleged jury misconduct. The experts claim that there was no outside influence on Hogan or other jurors in this case, which is what is needed to get a verdict overturned in a case like this. Hogan has responded that the judge didn’t ask for complete listing of all lawsuits he had been involved with. Therefore, it seems as if he gave the information asked of him, which might make it hard for Samsung to win this appeal.
